These Terms of Service govern your use of the Cyblitrades cybersecurity maturity assessment platform. By accessing or using our services, you agree to be bound by these terms. Cyblitrades services are intended for business entities only.
1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between Cyblitrades ("Company," "we," "us," or "our") and the business entity or authorized representative accessing or using the Cyblitrades platform ("Client," "you," or "your"). By registering for an account, accessing the platform, or using any services, you represent that you have the authority to bind your organization to these Terms.
2. Description of Services
Cyblitrades provides a cloud-based cybersecurity maturity assessment platform and related professional services, including:
- Self-service cybersecurity maturity assessments aligned to NIST frameworks
- Scoring, benchmarking, and reporting tools
- Industry and peer benchmark comparisons
- Direct messaging and support channels
- PDF report generation and export
- Consulting and advisory services (plan-dependent)
3. Eligibility and Account Registration
3.1 Business Use Only
Cyblitrades services are intended solely for business entities and qualified professionals. You represent that you are accessing the platform on behalf of a legitimate business organization.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at support@cyblitrades.com of any unauthorized use or security breach.
3.3 Accurate Information
You agree to provide accurate, current, and complete information during registration and to keep your account information updated.
4. Subscription Plans and Billing
4.1 Plan Tiers
Cyblitrades offers Free, Essential, Pro, and Concierge plan tiers. Features are described on our pricing page and may be updated with reasonable notice.
4.2 Payment Terms
Paid plans are billed in advance on a one-time, monthly, or annual basis. Subscription fees are non-refundable except as required by applicable law. Concierge plans require an annual commitment and are subject to separate commercial terms.
4.3 Automatic Renewal
Monthly and annual subscriptions renew automatically unless cancelled before the renewal date. You may cancel at any time through your account dashboard.
4.4 Price Changes
We reserve the right to modify pricing with at least 30 days' notice. Continued use after a price change constitutes acceptance.
5. Acceptable Use
Your use of the platform is subject to our Acceptable Use Policy, incorporated herein by reference. You agree not to use the platform to violate any applicable law, attempt unauthorized access, introduce malware, or use the platform for competitive intelligence against Cyblitrades.
6. Intellectual Property
6.1 Cyblitrades IP
The platform, including all software, assessments, methodologies, scoring algorithms, and documentation, is the proprietary property of Cyblitrades. Nothing in these Terms grants you any ownership interest in our intellectual property.
6.2 Client Data
You retain ownership of all data you submit to the platform. By submitting data, you grant Cyblitrades a limited, non-exclusive license to process that data solely to provide and improve the Services.
6.3 Aggregated Data
We may use anonymized, aggregated data to improve services, generate benchmarks, and develop insights, provided such data cannot identify you or your organization.
7. Confidentiality
Each party agrees to maintain the confidentiality of the other party's non-public information and to use such information solely to fulfill obligations under these Terms.
8. Data Privacy and Security
Your use of the platform is subject to our Privacy Policy, incorporated herein by reference. We implement commercially reasonable security measures to protect your data.
9. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. CYBLITRADES DISCLAIMS ALL IMPLIED WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Assessment results are informational only and do not constitute professional legal, regulatory, compliance, or security advice.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CYBLITRADES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF (A) FEES PAID IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).
11. Indemnification
You agree to indemnify and hold harmless Cyblitrades and its officers, directors, employees, and agents from claims arising out of your use of the Services, your violation of these Terms, or your violation of any third-party rights.
12. Termination
You may terminate your account at any time through the dashboard. We may suspend or terminate access immediately for breach of these Terms, fraudulent activity, or non-payment. Upon termination, your right to access the Services ceases immediately.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Florida, without regard to conflict of law provisions. Disputes shall be submitted to binding arbitration in Florida, except that either party may seek injunctive relief in any court of competent jurisdiction.
14. Modifications
We may modify these Terms at any time with at least 14 days' notice via email or platform notice. Continued use after the effective date constitutes acceptance.
